Inside the Corporation
The most regulated ground we dig on
Harpers Ferry takes its historic character seriously, and the permitting reflects that. A few things worth knowing before you plan a project inside the town limits:
Contractors need a town business license. The Corporation requires contractors and subcontractors to hold both a Corporation of Harpers Ferry and a State of West Virginia business license while working in town, and to remit B&O tax on the work performed. That's a real barrier for outfits from further away, and a reason to ask any contractor you're considering whether they're set up for it.
Review can involve more than one body. Timelines vary depending on whether the Board of Zoning Appeals, the Historic Landmarks Commission or the Planning Commission need to look at it. That's not a reason to avoid the project — it's a reason to start it early.
Floodplain adds requirements. If the property sits in the floodplain, additional requirements may apply, and the town's Code Enforcement Officer is the person to check with. Given the confluence of the Potomac and Shenandoah, this affects more property here than in most towns.
Wastewater in Harpers Ferry and Bolivar is handled by the Harpers Ferry-Bolivar Public Service District, an independent authority separate from both town governments — so sewer connections and laterals go through them rather than the county.

Outside the sewer service area, properties here are on septic — and the combination of slope and shallow rock makes siting harder than on flat farmland. A failed conventional perc doesn't mean no system; it usually means an engineered one. Permits go through the Jefferson County Health Department.

A driveway on a slope is a drainage structure whether you designed it that way or not. Crowned or sloped to shed water, ditched on the uphill side, with cross drains where the run is long enough to build up speed. Otherwise every storm carries your stone base down to the road.

What if we hit rock?
On these slopes it's likely, and we price for what we can see. If rock shows up that genuinely changes the scope, we stop and talk through options — rerouting, going around, or working through it — before continuing. You won't find out from the invoice.
Can a septic system go in on a steep wooded lot?
Often, but the perc test decides it. Slope and depth to bedrock both limit where a drain field can sit, and a lot that fails a conventional perc frequently still supports an engineered system. Get the site evaluation done before you commit to where the house goes.
Why does my driveway wash out every storm?
On a grade, almost always drainage. If there's no crown and no uphill ditch, the drive becomes the channel and carries your stone to the bottom. Cross drains at intervals and a proper ditch line fix it permanently; adding more stone to the top does not.
Do you do erosion control on slope work?
Yes, and on this ground it matters more than most places. Silt fence, stone construction entrances, seeding and straw. On a steep site, disturbed ground left bare through one wet season can undo a good part of the work.
Is my address actually in the town limits?
A lot of people are surprised to find it isn't. The Harpers Ferry mailing area covers a good deal of rural Jefferson County outside the Corporation, where county rules apply rather than town ones and there's no town business license or historic review involved.
