A pond is a dam with water behind it

That's the part people skip past. A pond looks like a hole you fill up, but most ponds around here are made by building an embankment across a draw — and an embankment holding water is a dam, whether anybody calls it that or not.

Which is why two things decide whether a pond project goes well, and neither of them is the digging. Does the ground hold water, and what does the permitting look like. Get those settled first and the rest is earthwork.

Site Evaluation & Excavation

Not every spot on a property will hold a pond. We look at the soil, the drainage area feeding it, the slope of the draw and where the water would go if the embankment ever let go. Sandy or rocky ground leaks; clay holds.

Dam & Clay Core

The part nobody sees and everything depends on. The core gets keyed into undisturbed ground below the embankment and built up in compacted lifts — not pushed up in a pile and shaped. A dam built by pushing dirt looks the same on day one and seeps by the second summer.

Spillways & Outlets

Every pond needs a plan for water it can't hold. A principal outlet to carry normal flow, and an emergency spillway cut into undisturbed ground to take the storm that overwhelms it. Ponds fail at the spillway far more often than through the dam.

What the rules actually say

This is where pond projects get expensive, and it's almost always a surprise. Three things worth knowing before you plan anything:

Most farm ponds are too small for state dam jurisdiction. West Virginia's Dam Control and Safety Act sets size thresholds that the great majority of private and farm ponds fall well under. And even a jurisdiction-size farm pond dam may qualify for an exemption if its purpose is primarily agricultural — livestock watering, irrigation, fish culture — provided there's no potential for loss of human life downstream if it failed. That determination comes from a dam break analysis by a licensed engineer, though it can be waived where downstream conditions make the answer obvious.

Being under the threshold is not the same as being off the hook. The DEP is explicit about this: building below jurisdiction size doesn't guarantee you won't be held liable in court if something downstream goes wrong. Build it right regardless.

Streams are the real trap. The threshold for what counts as a stream is very low — a channel with a rock bed counts even if it's dry most of the year. Go over, under or through one and a permit is required. If a wetland or stream is involved, the Army Corps enters the picture, and while a nationwide permit nominally reviews in 45 days, in practice it commonly runs three to nine months.

None of that means don't build a pond. It means find out which category yours falls into before you're committed to a date. We'll walk the site and tell you what we see — and where an engineer or a formal determination is needed, we'll say so rather than guessing.

Livestock water that doesn't depend on a pump, irrigation you're not buying, fishing off your own bank, and a piece of ground that's worth more than it was. Banks graded to a slope that mows and holds grass, rip-rap where wave action would otherwise cut in.

More of our pond work than new construction, honestly. Most farm ponds around here went in decades ago and have been slowly filling with sediment ever since. Drawn down, dug out, banks reshaped, and the outlet replaced while it's dry — which is the only sensible time to do it.

Do I need a permit to build a farm pond in West Virginia?

It depends on size and what the pond touches. The great majority of private and farm ponds fall below the size thresholds for the state's Dam Control and Safety Act. Even a jurisdiction-size farm pond dam may be exempt if its purpose is primarily agricultural and there's no potential for loss of human life downstream. But if a stream or wetland is involved, that's a separate permit regardless of size — and that's the one that catches people.

What counts as a stream?

Less than you'd think. A channel with a rock bed is generally considered a stream even if it's dry most of the year. If your planned work goes over, under or through one, a permit is required. It's worth establishing this before anything else, because it's the single biggest determinant of your timeline.

How long does pond permitting take?

If no stream or wetland is involved and the pond is under jurisdiction size, often not long at all. If the Army Corps is involved, a nationwide permit nominally reviews in 45 days but practical experience commonly runs three to nine months. Plan accordingly rather than assuming the short version.

Will my ground even hold water?

The honest answer is that soil decides it. Clay holds; sandy or rocky ground leaks, sometimes badly enough that a pond never fills. We look at the soil during the site visit and tell you what we see. Where the natural ground won't hold, a clay liner can often solve it — but that's a cost worth knowing about before you start, not after.

How much does a pond cost?

It varies more than almost anything else we do. Size and depth matter, but so do soil type, whether a liner is needed, how much embankment has to be built, and what the outlet and spillway require. A small excavated pond on good clay ground is a completely different number from an embankment pond needing an engineered outlet. We walk it and price it in writing.

Why does my old pond keep dropping?

Usually one of three things: the dam is seeping, the outlet is leaking around the pipe, or the pond has silted in shallow enough that evaporation outpaces inflow. They look similar from the bank and have very different fixes. Finding out which it is comes first.

Can an old pond be cleaned out?

Usually, yes, and it's often better value than a new one. Most farm ponds around here are decades old and have been slowly filling with sediment. Drawing it down and digging it back out restores the depth, and it's the right time to replace a failing outlet or repair the dam while everything is dry and accessible.

What's the difference between a farm pond and a detention pond?

Purpose. A farm pond is built to hold water — livestock, irrigation, fish. A detention basin is built to release it slowly, holding storm runoff back so it doesn't overwhelm downstream. They're built differently, permitted differently, and a detention basin is normally designed by an engineer as part of a site plan.

Do you build detention basins to an engineer's plan?

Yes, and that's how it should be done. These get inspected against the design, so the basin, the riser structure, the outlet and the outfall all get built to the drawing rather than to a rule of thumb. It's usually part of a larger site package with the storm sewer and erosion control.

What time of year is best for pond work?

Late summer through fall is usually best. Ground is at its driest, which matters enormously when you're compacting clay, and an existing pond being cleaned out is at its lowest. You can't build a proper compacted core out of saturated material, and we won't pretend otherwise to hit a date.
